Terms of Service

Welcome to WakeRup. These Terms of Service ("Terms") govern your use of the WakeRup mobile application (the "App") operated by Laurent & Sons Pty Ltd ("we", "our", or "us"), trading as WakeRup. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use WakeRup. By creating an account, you represent that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian.

2. Account Registration

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You may not create multiple accounts or share your account with others.

3. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Harass, bully, or abuse other users
• Impersonate another person or entity
• Attempt to gain unauthorized access to the App's systems or other users' accounts
• Use bots, scripts, or automated tools to interact with the App
• Manipulate streaks, challenges, or leaderboard data through dishonest means
• Upload or transmit malicious code or content

4. Challenges & Streaks

WakeRup provides alarm and challenge features designed to help you build morning habits. You acknowledge that:

• Challenge participation is voluntary and at your own discretion.
• Streaks are tracked based on alarm confirmation data and may reset if a confirmation is missed.
• We reserve the right to modify challenge parameters, difficulty levels, or rules at any time.
• Streak data and challenge progress are provided "as is" and may be affected by technical issues.

5. Social Features

WakeRup includes social features such as friends, groups, and leaderboards. By using these features:

• You consent to your display name, streak data, and challenge progress being visible to your friends and group members.
• You agree to treat other users with respect.
• We may remove users or content that violates these Terms or community standards.

6. Subscriptions & Payments

WakeRup may offer premium features through in-app subscriptions. If you purchase a subscription:

• Payment is processed through the Apple App Store.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions through your Apple ID settings.
• Refunds are handled by Apple in accordance with their refund policies.

7. Intellectual Property

The App, including its design, code, content, graphics, and branding, is owned by WakeRup and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the App without our written permission.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that:

• The App will be uninterrupted, error-free, or available at all times
• Alarm functionality will work in every scenario (device settings, battery optimization, and OS restrictions may affect alarm delivery)
• Streak or challenge data will be perfectly accurate at all times

WakeRup is not a medical device. It is a habit-building tool and should not be relied upon as your sole alarm for safety-critical situations (e.g., medication schedules, medical appointments).

9. Limitation of Liability

To the maximum extent permitted by law, WakeRup and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the App.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in behavior that is harmful to other users or the App. You may delete your account at any time from within the App (Home → your avatar → Profile → Delete account) or by contacting us.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
